As reported in 2017, there are approximately 11 million undocumented immigrants living in the United States that have no insurance and use the emergency departments as their main source for healthcare access (Sorrell, 2017). When a person that is undocumented needs preventative care, including surgeries, there is an ethical dilemma because that person does not have the insurance to help pay for the costs and are unable to pay for the procedures out of pocket. If the health care providers determine that Medicaid insurance does not cover the care that the patient needs, they will have to decide whether their professional principles of justice and beneficence obligate them to provide uncompensated care and, if so, whether there are justifiable limits to such care (Coyle, 2003). Many undocumented immigrants are not eligible for any healthcare coverage including Medicaid or Medicare.. Uninsured undocumented immigrants do have access to some healthcare services, regardless of their ability to pay. Federal law (EMTALA) requires Medicare-participating hospitals to provide screening and stabilization services for anyone who enters their emergency rooms, without regard for insurance or residency status (Norris, 2021). Illegal immigration is on the rise in 2021 due to the borders being more open for those seeking asylum and overwhelming numbers needing medical care during the pandemic of COVID-19. Many of these cases in Texas are placed under a charity pay or additional funding from the government at the end of the year to help cover a low percentage of undocumented/uninsured patient care. While this dilemma is at hand, the dilemma of caring for our own citizens is an issue when the border hospitals are filled with undocumented immigrants and having no room for the citizens of the city. As healthcare providers, we have a duty to treat all that walk through the emergency room doors and triage those that need immediate attention and discharge those that can be seen in a clinic setting.
